Nor I think will it be necessary for the Bank to consult the Public Trustee, since I believe the custodian pro- visions of the Trading with the Enemy Amendment Act 1914 do not apply to persons resident and carrying on business in territory occupied by the enemy. However we need not go into this.

We must, however, I think get an under- taking from the Bank that they will not part with the money without the consent of the Secretary of State. I have spoken to the Board of Trade about this, and they do not think it necessary for us to remit the case to them for their observations as we did

Houtro in the case of Degrelle Huren and Company. It is

to be observed that in this case we are dealing with

Bank and not merely with the merchant.

Before granting permission as suggested above

we should preposto see evidence supporting the

statements made in this latter.

We are obliged for your favour of the 6th instant

No. 39360/1915, in which you inform us that the gooda referred

to in our letter of the 25th August appear still to be the

property of the enemy shipper. In this connection we have

pleasure in giving you further information as follows:-

The bill for £97, 12. O drawn by Mr. Hugo C.A.Frovna,

Hamburg, on Mr. Hugo C.A. From, Hongkong, was negotiated by us

before the outbreak of War, namely on the 14th July, 1914,

and was duly paid by the drawee, We ourselves have, therefore,

no further financial interest in the goods relating to this bill,

but we understand the assets of Hugo C.A. Fromm are being

(undan an analen liquidated by Messrs.Lowe Bingham & Matthews for the benefit of

the creditors in Hongkong. Under date of the 19th July last

our Hongkong Branch wrote us on this subject as follows:-
